Many people still believe that leaving a job in the UAE means an automatic six-month or one-year labour ban. That has not been the general rule for years. Under Federal Decree-Law No. 33 of 2021 and its Implementing Regulation, most workers can move to a new employer once the contract ends properly. A one-year ban now applies only in a few specific cases. This guide explains when you can change jobs freely, when the ban applies, and what to check before you resign.
When you can move to a new employer
The UAE Government portal, citing Article 27 of Cabinet Resolution No. 1 of 2022, says a worker may work for another employer when the contract ends in line with the Labour Law, including when:
- the agreed contract term has expired and was not renewed
- the contract is ended during its term in a way the law allows, for example by mutual written agreement or by notice
- the worker ends the contract without notice for a reason the law accepts, such as the employer failing to meet its obligations after MOHRE has notified it
- the employer ends the contract without any fault on the worker's side
In each of these cases the worker can obtain a new work permit. The official conditions for moving to a new employer do not list a no-objection letter from the old employer; we confirm what your case needs before the new employer applies.
Notice periods after probation
Article 43 of the Labour Law lets either side end the contract for a legitimate reason with written notice. The notice period must be at least 30 days and no more than 90 days, as set in your contract. During notice:
- the contract stays in force and you are paid your full wage
- whoever fails to serve the notice owes the other side a notice period allowance based on the last wage
- if the employer ended the contract, you can take one unpaid day a week to look for work, with three days' warning
Both sides can agree in writing to shorten or waive the notice, as long as no one's rights are lost.
Changing jobs during probation
Probation can last up to six months. Article 9 of the Labour Law sets different rules depending on where you are going:
| Your plan | What the law requires |
|---|---|
| Move to another employer in the UAE | Give the current employer written notice of at least one month. The new employer compensates the old one for recruitment or contract costs, unless agreed otherwise. |
| Leave the UAE | Give at least 14 days' written notice. If you come back on a new work permit within three months of leaving, the new employer pays the compensation, unless agreed otherwise. |
| Employer ends your probation | The employer must give you at least 14 days' written notice. |
When the one-year ban still applies
The UAE Government portal lists three cases in which a worker can be barred from a new work permit for one year:
- The worker ends the contract during probation and the employer had not breached its obligations.
- A work abandonment (absconding) report against the worker is proven valid.
- The worker's permit was with a fictitious establishment and was cancelled.
The ban is imposed after a complaint by the employer, which MOHRE reviews before deciding. The ban period starts once the worker leaves the UAE and ends automatically.
In the case of a proven work abandonment report, the following groups are exempt: workers on family residence visas, workers taking a new permit with the same establishment, workers at skill or knowledge levels the UAE needs, Golden Visa holders, and other categories set by ministerial decision. If an absconding report is the issue, our guide on how to cancel an absconding report explains the MOHRE process.
How to check or contest a ban
Call the MOHRE call centre on 600 590000 (MOHRE lists the line as available 24/7, and the UAE Government portal notes it serves several languages) or use MOHRE's other official channels. To contest a ban, submit a grievance through MOHRE's channels and attach documents showing why the ban is not justified, such as proof that the employer breached the contract or that you served the required notice.
Your grace period after the job ends
Once your residence is cancelled, you have a grace period to find a new job or leave. ICP's residence service lists these periods:
- 30 days for most categories
- 60 days for residence issued with a guarantor or host
- 90 days for skilled workers at levels 1 to 3 and property owners
- 180 days for Golden, Green and Blue residence holders and their families
After the grace period, ICP charges AED 50 for each extra day. More detail is in our guide to visa cancellation and grace periods.
How the new employer hires you
For a worker already in the UAE, the new employer applies to MOHRE for a transfer work permit. MOHRE lists a completion time of two working days. The two-year permit fee depends on the company's MOHRE category: AED 250 for category 1, AED 1,200 for category 2 and AED 3,450 for category 3, plus AED 50 for the transfer permit, before tax and collection charges. Then the residence is issued under the new sponsor, usually without leaving the country; see changing visa status inside the UAE.
Before you resign: a short checklist
- Read your contract for the notice period and any non-compete clause.
- Confirm whether you are still on probation, and count the notice from the date you give it in writing.
- Get your resignation acknowledged in writing or by email.
- Make sure the old employer cancels the work permit and residence in time, and keep the cancellation papers.
- Check that no complaint or absconding report has been filed before your new employer applies.

Frequently Asked Questions
Is there still a six-month labour ban in the UAE? No. Under the current Labour Law there is no general ban for changing jobs. A one-year ban applies only in specific cases, such as resigning during probation when the employer was not at fault, a proven absconding report, or a cancelled permit at a fictitious company.
Do I need an NOC from my employer to change jobs? The official conditions for changing employer do not list one. If your contract ended in a way the law allows, the new employer can apply for a transfer work permit; we confirm the documents your case needs.
How much notice do I give if I am on probation? At least one month in writing if you are moving to another UAE employer, and at least 14 days if you are leaving the country.
When does a labour ban start? The UAE Government portal says the ban period starts once the worker leaves the UAE, and it is lifted automatically when the period ends.
How long can I stay in the UAE after my visa is cancelled? Most residents get 30 days. Some categories get 60, 90 or 180 days, depending on the residence type, according to ICP.
